Burgundy Select Booking Terms & Conditions

1. Accommodation available at the property you have requested ("the Property") is offered for holiday rental subject to confirmation by Burgundy Select (BSelect) to the renter ("the Client"). BSelect is acting as the agent for and on behalf of the property owners (“the Owner”) to facilitate the booking process.

2. Prices include electricity, supply of laundry to include bed linen, towels and tea towels.

3. To reserve the Property, the Client should pay the deposit, (online booking or by phone booking), BSelect will then email a receipt for the payment along with the due dates for the remaining balance. This is the formal acceptance of the booking.

4. The deposit payment is non refundable.

5. The balance of the rent is payable not less than eight weeks prior to the start of the rental period. If payment is not received by the due date, BSelect reserves the right to give notice in writing that the reservation is cancelled. Reservations made within eight weeks of the start of the rental period require full payment at the time of booking.

6. Should the Client need to terminate the stay early, there will be no reimbursement of rent. The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for personal belongings, public liability, accident or other unforeseen eventualities, since these are not covered by the Owner’s insurance.

7. BSelect shall not be obliged to offer access to the site, facilities or accommodation before the time stated on the property details and booking form and the Client shall not be entitled to remain in occupation after the time stated on the booking form and property details.

8. The Client agrees to be a considerate tenant and to take good care of the Property and on departure adhere to the points covered on the departure check list.

9. The Client also agrees not to act in any way which would cause disturbance to neighbouring residents or people in the local area.

10. The maximum number of people to reside in the Property must not exceed that stated in the Property information details, unless the Owner has given specific permission.

11. The Client agrees not to use the rental agreement to benefit in any way from any third party, person or enterprise unless by written agreement from the Owner.

12. The Client accepts that a 'No Smoking' policy inside the property is in operation.

13. The Client shall report to BSelect/Maintenance Person (MP) without delay, any defects in the Property or breakdown in the equipment, plant, machinery or appliances in the Property and grounds. BSelect/MP will arrange for repair and/or replacement to be made as soon as practically possible.

14. BSelect shall not be liable to the Client for any temporary defect or stoppage in the supply of public services to the Property nor in respect of any equipment, plant, machinery or appliances in the Property or grounds or for any loss, damage or injury which is the result of adverse weather conditions, riots, strikes or other matters beyond the control of BSelect.

15. In the event of any loss, damage or inconvenience caused to or suffered by the Client, if the property is not fit for rental purposes, shall be destroyed or substantially damaged for any reason whatsoever before the start of the rental period, then BSelect shall, within thirty days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.

16. For any loss, damage or injury caused by the Client's use of the accommodation, amenities or to the Client's vehicles and belongings or incurred by the Client during any activities, then BSelect shall not be liable. With regard to the use of a swimming pool, children must never be left unattended. It is the parent’s responsibility to watch and supervise their children in and round the swimming pool at all times.

17. Cancellations:

IF WE CANCEL THE RENTAL:
If, after we have confirmed your booking, we cannot supply the Property to you because of reasons beyond our control, we will offer you alternative accommodation which is at least as good, if at all possible. If you do not want this accommodation or if we cannot offer you alternative accommodation we will return the Rental Price to you in full.

IF YOU CANCEL THE BOOKING:
If you cancel the booking for any reason, you must tell us in writing. You just send the notice to us by prepaid special delivery, preferably backed up by an email or telephone call to warn us.The cancellation will take effect from the date that such written notice is received by us (You can assume we have received it 72 hours after posting). If you cancel a booking we will charge the cancellation fee set out below. The percentage of the Rental Price we charge as a cancellation fee will depend on the time left before your rental is due to start.?(a) If we receive your cancellation 57 or more days (eight weeks plus one day or more) before you are due to arrive, you will only lose the original deposit. (b) If we receive your cancellation on any day between the 56th day (eight weeks) before the date you are due to arrive and the 29th day (four weeks plus one day) before the date you are due to arrive you will lose 50% (half) of the Rental Price.?(c) If we receive your cancellation on any day including or after the 28th day before your arrival date, or whilst the holiday is in progress, then you will lose 100% (all) of the Rental Price.

18. Under no circumstances shall BSelect’s liability to the Client exceed the amount paid in respect of the rental period.

19. Whilst every effort has been made to ensure that the details provided are accurate, the representations and details shall not give rise to any liability on the part of BSelect. Every effort will be made to notify any changes in the details prior to the commencement of the holiday.

20. Payment of the balance is acknowledged as the guest’s acceptance of these terms and conditions, regardless of reservation mode (online or by phone). Online bookings remain provisional until confirmed in writing (email) by BSelect. If subsequent changes are made to either dates and/or property by the guest, an administration charge of £25 will be levied per change.

21. There is no credit or debit card supplement and payment is in GBP£.

22. Complaints procedure – you must notify the Agent - BSelect or Owner during your stay at the earliest opportunity:

Whilst complaints are rare it is important to inform you of our complaints policy. On the rare occasions that problems occur it is usually for minor issues, which can be resolved quickly. Compensation will not be given for any complaints received by the Agent or Owner after the departure of the guest. The reason for this is that it is very difficult to prove when a problem occurred after departure. Secondly, the owner does not have an opportunity to rectify the problem.

When we do not offer compensation:
a. If a complaint is received by the Owner or agent after departure.

b. The issue can be classed as an “Act of God”. We recommend that all guests take out travel insurance prior to their stay, which would cover circumstances beyond the control of the guest to spoil their holiday.

23. All persons using a swimming pool (where there is the use of a swimming pool provided by the owner) do so at their own risk. BSelect assumes no responsibility for any accident or injury in connection with such use, or for any loss or damage to personal property. The pool maintenance is the responsibility of the owner, and if for any reason the pool is not available for guest use, BSelect cannot be held responsible, legally or financially. Should the Owner provide the use of a swimming pool then detailed pool complex rules are displayed in your holiday property:

POOL COMPLEX RULES       

1.   POOL USE IS FOR GUESTS ONLY.
2.   CHILDREN UNDER 16 YEARS OLD MUST BE ACCOMPANIED BY A RESPONSIBLE ADULT.
3.   USERS MUST SHOWER BEFORE USING THE POOL COMPLEX.
4.   NO RUNNING, JUMPING OR DIVING IN THE POOL COMPLEX AREA.
5.   NO LONE SWIMMING.
6.   EMERGENCY EQUIPMENT MUST NOT BE USED FOR RECREATIONAL PURPOSES.
7.   NO FOOD OR DRINK TO BE CONSUMED IN THE POOL COMPLEX
8.   NO GLASS ALLOWED IN THE COMPLEX AREA
9.   USERS SHOULD NOT USE THE POOL COMPLEX IF THEY HAVE A MEDICAL CONDITION THAT MAY BE AGGRAVATED BY POOL USE
10.   The PM or PROPERTY OWNER RETAIN THE RIGHT TO REFUSE ACCESS OR CLOSE THE POOL AT ANY TIME.
